Terms of sale
These terms apply to every order placed with Spark Precision Fabrication ("Spark Fabrication", "we") through sparkfab.ca, by email, by phone or in person. Placing an order means you accept them.
Made to order, no returns
Everything we sell is cut, machined or built to your order: foam sheets are cut to the size you choose, inserts are machined to your design, and fabricated parts are made to your drawings. Because of that, all sales are final. We don't accept returns, exchanges or cancellations once work has started, and no refund is owed for a change of mind, a wrong size or colour chosen at checkout, or a design that doesn't fit the tools or case it was meant for.
Check your order
Sizes are shown in millimetres and drawn to scale on each product page; the cart lists every size, thickness, colour and quantity before you pay. You are responsible for checking them. For a custom insert, you are responsible for the design you send: its dimensions, the depth of each pocket and whether the tools fit. We check every design for things we can't cut and may contact you about it, but we don't check it against your tools or case.
Prices, estimates and payment
Prices are in Canadian dollars before GST and PST. Prices from the foam designer and the tube laser estimator are estimates based on the information you give us; a quote we confirm in writing is the price. Orders are paid in full at checkout or before work starts unless we have agreed to other terms in writing. We may correct a price that is obviously wrong before accepting an order.
Lead times and shipping
Lead times we give are our best estimate, not a guarantee. Shipping prices shown in the cart are estimates for one address in Canada; the carrier's final charge may differ for oversized or remote deliveries, and we'll contact you before shipping if it does. Risk of loss passes to you when we hand the parcel to the carrier or when you pick it up. If a parcel arrives damaged, tell us within 48 hours with photos of the box and the contents and we will replace the damaged pieces or refund them, at our choice.
Our mistake
If we cut something that doesn't match the order or the design we accepted, tell us within 7 days of receiving it and we will re-make it. This is the only remedy we offer, and it's limited to the price you paid for that item.
Materials and use
Foam colours, densities and surface finish can vary slightly between batches and from the photos on screen. Our products are not tested or certified for any particular application; you are responsible for deciding whether they are suitable for yours. Nothing we sell is intended for use as safety equipment.
Designs and files
Designs and drawings you send us stay yours. You confirm that you have the right to use them and that making the part won't infringe anyone's rights. We keep copies so we can re-make your order and improve our tools; see the privacy policy.
Limitation of liability
To the extent the law allows, our total liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential losses such as lost time, lost profit or damage to the tools or equipment you store in our products. Nothing in these terms limits rights that can't be limited under the laws of British Columbia.
Law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Any dispute will be dealt with in the courts of British Columbia. We may update these terms; the version on this page when you order is the one that applies.
